Terms and Conditions

1. Acceptance of Terms; Modifications. These Terms of Service (the “Terms”) are a binding legal agreement between you and A Place for “The Chew Chew Station” (“The Chew Chew Station Service(s)”, “The Chew Chew Station’s”). The Terms govern your use of The Chew Chew Station’s software applications, resources, and services for pet owners to communicate with The Chew Chew Station, and arrange for the provision of pet care services (collectively, The Chew Chew Station’s Service). The Terms govern all use of The Chew Chew Station Services, whether you access it from The Chew Chew Station’s website at https://www.thechewchewstation.com (the “Site”), The Chew Chew Station’s mobile applications and mobile websites, The Chew Chew Station’s Facebook application, The Chew Chew Station’s phone, or any other access point made available to you. The Chew Chew Station’s Reservation Protection Policy and other Policies applicable to your use of The Chew Chew Station Service are incorporated by reference into these Terms of Service. BY ACCESSING OR USING THE CHEW CHEW STATION SERVICES, YOU ACCEPT THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, YOU SHOULD NOT ACCEPT THEM, IN WHICH CASE YOU DO NOT HAVE THE RIGHT TO USE THE CHEW CHEW STATION SERVICES.
You understand and agree that The Chew Chew Station may change the Terms from time to time and that any such changes will be effective immediately when The Chew Chew Station posts the modified Terms on The Chew Chew Station website. Your continued access and use of The Chew Chew Stations Services after The Chew Chew Station post the modified Terms will constitute your consent to be bound by the modified Terms.
2. Transactions are between Pet Owners and Service Providers.
2.1 Bookings. Pet Owners and The Chew Chew Station Services transact with each other on the The Chew Chew Station Service when they both agree to a “booking” that specifies the fees, time period, cancellation policy, and other terms for provision of Pet Care Services via the booking mechanism provided on The Chew Chew Station Service (a “Booking”). Once you complete a Booking, you agree to honor the price and other terms of that Booking.
2.2 Abandoned Pets; Rehoming. Pet Owners who arrange for Pet Care Services and fail to retrieve their pet within seven (7) days after the service period identified in a Booking (or an earlier period required under applicable animal abandonment or cruelty laws) agree that The Chew Chew Station may, in its sole discretion, place the pet in foster care and/or notify animal control authorities. Pet Owner agrees to reimburse The Chew Chew Station for all costs and expenses associated with such actions. Further, The Chew Chew Station expressly reserves the right, in its sole discretion, to remove a Pet Owner’s pet from The Chew Chew Station’s care should The Chew Chew Station deem it necessary for the safety of a pet, The Chew Chew Station Staff, or any persons living with The Chew Chew Station’s Staff. Prior to removing a pet from the care of The Chew Chew Station, The Chew Chew Station will use reasonable efforts during business hours to contact the Pet Owner and/or the Pet Owner’s emergency contact (if provided) to arrange alternative care. Should The Chew Chew Station not be able to contact the Pet Owner or the emergency contact, The Chew Chew Station will use its best judgment to find alternative care for the pet until the Pet Owner is able to retrieve his/her pet. If you are a Pet Owner, you authorize your pet’s veterinarian(s) to release your pet’s veterinary records to The Chew Chew Station in connection with any such relocation or re-homing of your pet. In addition, you are responsible for and agree to pay all costs and expenses incurred by The Chew Chew Station in connection with such transfer, including any additional charges for new Bookings.
2.3 Emergencies.
· The Chew Chew Station recommends that Pet Owners give The Chew Chew Station contact information where they can be reached in the event medical care for a pet becomes necessary. The Chew Chew Station agrees to immediately contact Pet Owners in the event such care becomes necessary. If you are a Pet Owner, you hereby authorize The Chew Chew Station to obtain and authorize the provision of veterinary care for your pet if you cannot be reached to authorize care yourself in an emergency situation. In such a case, you also authorize your pet’s veterinarian(s) to release your pet’s veterinary records to The Chew Chew Station. If The Chew Chew Station reaches you with a request to authorize medical care for your pet and you refuse, you release The Chew Chew Station for any injury, damage or liability arising from failure to seek such care, including from reimbursement that may otherwise have been available. Pet Owners are solely responsible for the costs of any such medical treatment for pets and, if you are a Pet Owner, you hereby authorize The Chew Chew Station to charge your payment method for such costs. In certain circumstances, a Pet Owner may be eligible for reimbursement.
· If safety concerns for The Chew Chew Station’s household, including pets, you will not be refunded. Up to date shot, records must be provided prior to any booking.
3. Eligibility; Legal Compliance.
· By accessing and using The Chew Chew Station Services, you certify that you: (1) are 18 years of age or older, and (2) will comply with all laws and ordinances applicable to your activities conducted through The Chew Chew Station’s website. For Pet Owners, this means, among other things, that you will ensure that your pets are vaccinated and licensed as required by local law. You acknowledge that The Chew Chew Station is entitled to rely on these commitments.
· Up to date shot records must be provided prior to any booking.

3.1 Equipment.
· Pet Owners are responsible in assuring that their pet(s) equipment is safe, in good condition, and up to date, i.e. not recalled. The Chew Chew Station is not responsible for accidents caused by faulty equipment such as improperly fitted collars, collars without valid ID, no collar, retractable leashes breaking, or any other equipment that is provided by the Pet Owner that is old, cheap, fragile, not properly sized, etc.

3.2 The Chew Chew Station can not and will not be held liable for injury or death to any person, pet(s), any other animal, and or the lose of a pet due to faulty equipment provided by the Pet Owner.

3.3 The Chew Chew Station can not and will not be held liable for injury or death to any person, pet(s), any other animal, and or lose of pet, resulting in care instructions left by the Pet Owner.

3.4 The Chew Chew Station can not and will not be held liable for injury or death to any person, pet(s), any other animal, or lose of pet, resulting in the Pet Owner not providing full, accurate information about their pet, equipment, care instructions, and or environment, etc.

3.5 The Chew Chew Station can not and will not be held liable for injury or death to any person, pet(s), any other animal, or lose of pet, resulting in the Pet Owners choice to leave their pet "free roam".
- Free roam pets meaning pets left unattended in the Pet Owners home during Drop-In Visits, House Sitting, and or Dog Walking.

3.6 The Chew Chew Station can not and will not be held liable for property damage caused by "free roam" pets if the Pet Owner chooses to leave their pet(s) "free roam".

3.7 The Chew Chew Station can not and will not be held liable for people other than Kate (The Chew Chew Station and other Associates i.e. IC's if applicable.) in the Pet Owners home, i.e. family members, friends, workers, uninvited people, "other people", etc.

3.8 The Chew Chew Station can not and will not be held liable for property damage caused by "other people" present in the Pet Owners home.

3.9 The Chew Chew Station can not and will not be held liable for injury or death to any person, pet, any other animal, or lose of pet, resulting in "other people" present in the Pet Owners home.
4. Use of The Chew Chew Station Services; Suspension.
4.1 Your Conduct on The Chew Chew Station Services. When you use the The Chew Chew Station Services, you agree:
· To use the The Chew Chew Station Services only in a lawful manner and only for its intended purposes.
· Not to use The Chew Chew Station Services to arrange for the care of exotic or inherently dangerous pets such as venomous snakes or constrictors, primates, wolves or wolf hybrids, non-domesticated cats, alligators, pets with separation anxiety, or any animal with a history of attacks on pets or people.
· Not to submit viruses or other malicious code to or through The Chew Chew Station Services.
· Not to use The Chew Chew Station Services, or engage with other users of The Chew Chew Station Services, for purposes that violate the law.
· Not to post reviews about Service Providers that aren’t based on your personal experience, that are intentionally inaccurate, or that violate these Terms.
· Not to post content or materials that are pornographic, threatening, harassing, abusive, or defamatory or that contains nudity or graphic violence, incite violence, violate intellectual property rights, or violate the law or the legal rights (for example, privacy rights) of others.
· Not to post “spam” or other unauthorized commercial communications.
· To use The Chew Chew Station Services only for your own purposes, and not to impersonate any other person.
· Not to transfer or authorize the use of your account for The Chew Chew Station Services by any other person.
· Not to provide false information in your profile on, or registration for, The Chew Chew Station Services.
· Not to interfere with the provision of, or any other user’s use of, The Chew Chew Station Services.
· Not to solicit another user’s username and password for The Chew Chew Station Services.
4.2 Suspension and Termination. You understand and agree that The Chew Chew Station has no obligation to provide The Chew Chew Station Service to you, nor any obligation to continue providing it once we have begun. If The Chew Chew Station believes your conduct on the Site or The Chew Chew Station Service is inappropriate, unsafe or violates these terms, and for any other reason (or no reason at all), The Chew Chew Station reserves the right to suspend or terminate your access to The Chew Chew Station Services at its sole discretion.
5. Registration; Account Security. In order to use some aspects of The Chew Chew Station Services, you will be required to create a username, password, and user profile. If you elect to use The Chew Chew Station Services, you agree to provide accurate information about yourself and keep this information up-to-date. You agree not to impersonate anyone else and not to maintain more than one account (or, if The Chew Chew Station suspends or terminates your account, not to create further accounts). You are responsible for maintaining the confidentiality of your username and password for The Chew Chew Station Services, and you agree not to authorize anyone else to use your username and password. You are responsible for all activity under your account. You agree to notify The Chew Chew Station promptly of any unauthorized use of your account.
6. Privacy. Our collection and use of your personal information on The Chew Chew Station Services is described in our Privacy Policy. By accessing or using The Chew Chew Station Services, you acknowledge and consent to the Privacy Policy.
7. Your Content.
7.1 Your Content. The Chew Chew Station may require or allow you (or someone else on your behalf) to submit or upload text, photographs, images, videos, reviews, information and materials to your profile on the The Chew Chew Station website or otherwise in connection with using The Chew Chew Station Services and/or participating in promotional campaigns The Chew Chew Station conducts on the Site (collectively, “Your Content”). For example, The Chew Chew Station’s Facebook page “The Chew Chew Station” may upload a photograph to said page. Or to transmit photos of the dogs under The Chew Chew Stations care to Pet Owners, while Pet Owners may submit reviews of The Chew Chew Stations care.
7.2 License. Except for the limitations on the use and disclosure of personal information described in the Privacy Policy, you grant The Chew Chew Station an irrevocable, perpetual, non-exclusive, fully paid worldwide license to use, copy, perform, publicly display, reproduce, adapt, modify, transmit, broadcast, prepare derivative works of, and/or distribute Your Content in connection with providing and/or promoting The Chew Chew Stations Service.
7.3 Release. If your name, voice, image, persona, likeness, or performance is included in any of Your Content, you hereby waive, and release The Chew Chew Station from any claim or cause of action, whether known or unknown, for defamation, copyright infringement, invasion of the rights of privacy, publicity, or personality, or any similar claim arising out of the use of Your Content in accordance with the license in Section 7.2 and the other provisions of these Terms.
7.4 Your Representations and Warranties about Your Content. You represent and warrant that (1) you are the owner or licensor of Your Content and that you have all rights, consents and permissions necessary to grant the license in Section 7.2 and make the release in Section 7.3 with respect to Your Content, (2) that you have any necessary consents and releases from individuals who appear or whose pets appear in Your Content; and (3) Your Content does not violate the law or these Terms.
7.5 Right to Remove or Screen Your Content. Though The Chew Chew Station is not obligated to do so, The Chew Chew Station reserves the right to monitor, screen, edit and/or remove Your Content on The Chew Chew Station Services. The Chew Chew Station’s enforcement of these Terms with respect to Your Content is at The Chew Chew Station’s discretion, and failure to enforce the Terms in one instance does not create a waiver of your right to enforce them in another instance. The Chew Chew Station has no obligation to retain or provide you with copies of Your Content, nor will The Chew Chew Station have any liability to you for any deletion, disclosure, loss or modification to Your Content. It is your sole responsibility to maintain backup copies of Your Content.
8. Phone, Text and Mobile Communications.
8.1 Consent to Auto-dialed Text Messages and Phone Calls. You consent to The Chew Chew Station communicating with you about the The Chew Chew Station Services by SMS, text message, email and other electronic means, including auto-dialed text messages and phone calls containing service information and/or marketing messages. Your carrier's normal messaging, data and other rates and fees will apply to these communications. You are not required to provide this consent to receive marketing messages as a condition of purchasing anything or using The Chew Chew Station Services, and you may opt-out of receiving these messages and calls at any time.
9.Fees & Payment.
9.1 Fees for Pet Owners. Pet Owners may purchase Pet Care Services from a Service Provider by completing a Booking as described in Section 2.5. If you are a Pet Owner, you enter into a transaction with the Service Provider when you accept a Booking, and you agree to pay the total fees indicated in the Booking. Except where otherwise specifically indicated on The Chew Chew Station Services.
9.2 Payment Obligation for The Chew Chew Station. The Chew Chew Station may agree to provide Pet Care Services to a Pet Owner by agreeing to a Booking as described in Section 2.5. The Chew Chew Station must confirm the Booking or the Pet Care Owner will have no obligation to complete the transaction. Once the Booking is completed by both parties, you agree to honor the price set forth in your Booking. The purchase of Pet Care Services is a transaction between the Pet Owner and the Service Provider.
9.3 Late Fees and Additional Charges.
· If you are a Pet Owner, you acknowledge and agree that, if you fail to retrieve your pet at the end of the service period agreed in a Booking, you will be charged for additional service time (pro-rata for each partial late day) at the daily rate established in the Booking. In addition, you agree to indemnify The Chew Chew Station from and agree that The Chew Chew Station may charge your payment method for, any additional costs and expenses The Chew Chew Station incur as a result of your failure to retrieve your pet at the end of the service period agreed in a Booking.
· Pet Owners agree to comply with late fees such as late fees for pickups and late fees for drop-offs.
· A $2.50 late fee will be applied for every 30 minutes past time for both drop-off and pickups.
9.4 Cancellations and Refunds.
· Cancellations by The Chew Chew Station. If The Chew Chew Station cancels a Booking prior to or during the service period identified in the Booking, The Chew Chew Station will refund the fees paid by the Pet Owner for Pet Care Services not provided based on the cancellation policy.
o If the reservation is canceled due to safety concerns for The Chew Chew Station’s household, including pets, you will not be refunded.
· Reservation Protection. If a Booking is canceled by The Chew Chew Station due to the Pet Owner’s failure to provide accurate or complete information regarding the pet or Booking, the Pet Owner is responsible for the full cost of any new reservation.
· Cancellations by Pet Owner. If a Pet Owner cancels a Booking prior to or during the service period specified in a Booking, they will be refunded according to the cancellation policy. If the Booking was canceled 7 days prior to the start of the Booking they Owner will receive a full refund, or as seen fit.
· Force Majeure. The cancellation policies described herein may not apply in the event of certain emergency situations beyond the control of The Chew Chew Station Services and/or Pet Owners that make it impossible or impractical to perform agreed Bookings, such as evacuations resulting from hurricane, wildfire or other natural disasters. In such cases, The Chew Chew Station may, in its reasonable discretion, issue refunds.
9.5 Authorization to Charge. When you pay for Pet Care Services or for other services on The Chew Chew Station Service, you will be required to provide The Chew Chew Station with valid, up-to-date payment information. You authorize The Chew Chew Station to charge your payment method for fees you incur on The Chew Chew Station Service as they become due and payable. You are responsible for maintaining up-to-date payment information. If The Chew Chew Station cannot charge you for fees when due because your payment information is no longer valid, or if The Chew Chew Station did not receive your payment when due, then you understand that The Chew Chew Station will not be responsible for any failure to provide services associated with those fees. Except as expressly provided in these Terms, all fees paid via The Chew Chew Station Service are non-refundable once paid.
10. Copyright Infringement.
If you believe in good faith that your copyrighted work has been infringed by content posted on The Chew Chew Station Service, please provide a written notice that includes all of the following information:
· A description of the copyrighted work you believe to have been infringed;
· A description of the URL or other location on our Site of the material you believe to be infringing;
· Your name, mailing address, telephone number, and email address;
· A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
· A statement by you, which you make under penalty of perjury, that the above information in your notice is accurate, and that you are the copyright owner or authorized to act on the copyright owner’s behalf; and
· An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
11. Third-Party Services, Links. The Chew Chew Station Service may contain links to third-party websites or resources. You acknowledge and agree that The Chew Chew Station is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement of such websites or resources, or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
12. The Chew Chew Station Trademarks. The Chew Chew Station owns all rights in and to its trademarks, brand names, and logos.
13. Privacy Policy. This Privacy Statement does not apply to websites, applications, or services that display or link to different privacy statements. Changes may be made to this Privacy Statement from time to time. If changes are made, The Chew Chew Station will notify you by revising the date at the top of the Privacy Statement. If material changes are made to this statement, The Chew Chew Station will provide you with notice or obtain consent regarding such changes as may be required by applicable law. The Chew Chew Station encourages you to review the Privacy Statement whenever you access the Services or otherwise interact with The Chew Chew Station to stay informed about our information practices and the ways you can help protect your privacy.
13.1 Collection of Information.
· Information we collect depends on how you interact with us, the Services you use, and the choices you make. We collect and process information about you with your consent and/or as necessary to provide the products and services you use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our customers, or fulfill other legitimate interests.
· We collect information about you in various ways when you use our Services, including the information you provide directly, information collected automatically, and third-party data sources.
14. Information You Provide to Us.
· We collect the information you provide directly to us. For example, we collect information when you create an account, post or reserve a listing, make a payment, write a review, communicate with other users through our Services or participate in any other interactive features of the Services. We also collect information when you participate in a contest, promotion or survey, communicate with us via third-party social media sites, request customer support, or otherwise communicate with us. The types of information we may collect include basic user information (such as your name, email address, postal address, phone number, photos, gender, and date of birth); pet information (such as breed, age, photos, veterinarian, and immunization status).
· We may also collect and store limited payment information from you, such as payment card type, expiration date and a portion of your payment card number; however, we do not store or have access to full payment card numbers as all transactions are processed by our third-party payment processors.
· In some cases, we may also collect the information you provide about others, such as when you send an email to one of your personal contacts using our Services. In such a case, we will use this information solely to fulfill your request, and not to otherwise send promotional communications to those contacts.
· When you are asked to provide information, you may decline. But if you choose not to provide information that is necessary for certain products or features, those products or features may not be available or function correctly.
· We may use information about you for various purposes as described in this Privacy Statement or disclosed to you in connection with our Services, including to:
15. Use of Information.
· Provide, maintain and improve our Services;
· Facilitate and process transactions and send you related information, including booking and payment confirmations.
· Send you technical notices, updates, security alerts, and support and administrative messages;
· Respond to your comments, questions, and requests and provide customer service;
· Communicate with you about products, services, offers, promotions, rewards, and events offered by The Chew Chew Station and others, and provide news and information we think will be of interest to you;
· Monitor and analyze trends, usage, and activities in connection with our Services;
· Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of The Chew Chew Station and others;
· Personalize and improve the Services and provide advertisements, content or features that match user profiles or interests;
· Facilitate contests, sweepstakes and promotions, and process and deliver entries and rewards;
· Link or combine with information we get from others to help understand your needs and provide you with better service; and
· Carry out any other purpose described to you at the time the information is collected.
16. Sharing of Information.
· When you sign up for and participate in the interactive areas of our Services (such as when you create a user profile or write a review), certain information about you may be displayed publicly, such as your name and photo.
· With vendors, consultants and other service providers who need access to such information to carry out work on our behalf;
· In response to a request for information if we believe disclosure is in accordance with or required by, any applicable law, regulation or legal process;
· If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property or safety of The Chew Chew Station, its users (including their pets), or the public;
· With your consent or at your direction.
17. Social Sharing Features. The Services may offer social sharing features and other integrated tools (such as the Facebook “Like” button), which let you share actions you take on our Services with other media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. For more information about the purpose and scope of information collection and processing in connection with social sharing features, please visit the privacy policies of the entities that provide these features.
18. Advertising and Analytics Services Provided by Others. We may allow others to provide analytics services and/or serve advertisements on our behalf across the Internet. These entities may use Cookies to collect information about your use of our websites and third-party websites.
19. Security. The Chew Chew Station takes reasonable measures designed to help protect information about you from loss, theft, misuse and unauthorized access, use, disclosure, alteration, and destruction.
